Terms & Conditions of the originsoflight.com online store
These Terms & Conditions set out the rules for making purchases in the originsoflight.com online store operated by LIGHTU Sp. z o.o. with its registered office in Marki, in accordance with applicable Polish law, including the Consumer Rights Act and the GDPR.
I. Definitions
- Online store — the website available at originsoflight.com, through which the Customer may place Orders.
- Seller / Service provider — LIGHTU Sp. z o.o., ul. Dojazdowa 3A, 05-270 Marki, Poland, NIP (Tax ID): 1251796563, REGON: 543044936, KRS: 0001201307.
- Customer — a natural person, legal person or organizational unit without legal personality making purchases in the Store.
- Consumer — a Customer who is a natural person making a purchase not directly related to their business or professional activity.
- Goods — the products presented in the Store, in particular lamps, lighting fixtures, bulbs and accessories.
- Order — a declaration of the Customer’s will aimed directly at concluding a distance contract for the sale of Goods.
- Sales contract — a contract for the sale of Goods within the meaning of the Polish Civil Code, concluded between the Seller and the Customer.
II. General rules for using the Store
The Store sells at retail and wholesale via the Internet. Orders are accepted through the originsoflight.com website 7 days a week, 24 hours a day.
Placing an Order requires:
- reading and accepting these Terms & Conditions,
- providing true information necessary to process the Order,
- consenting to the processing of personal data to the extent needed to perform the contract.
The Customer is obliged to use the Store in a manner consistent with the law and good practice, with due respect for the personal rights and intellectual property rights of third parties.
III. Technical requirements for using the website
Using the Store properly requires a device with Internet access, an up-to-date web browser that supports cookies, and an active e-mail account.
The Seller makes every effort to keep the Store running continuously. However, it reserves the right to short technical breaks related to maintenance, updates or upgrades of the system.
IV. Placing and processing Orders
To place an Order, the Customer adds the selected Goods to the cart and then completes the Order form, choosing the delivery method and the form of payment.
Placing an Order is confirmed by an e-mail sent to the address provided by the Customer. The sales contract is concluded when the Seller confirms acceptance of the Order for processing.
Order processing begins once the payment is credited to the Seller’s account or — if cash on delivery is chosen — once the Order is confirmed. The standard processing time is 2 to 14 business days. For lamps made to individual order, the completion time is agreed with the Customer on a case-by-case basis.
V. Prices, Goods and forms of payment
The prices of the Goods are expressed in Polish zloty (PLN) and include VAT. The price shown next to the Goods is binding at the time the Order is placed.
Available forms of payment:
- a traditional transfer to the Seller’s bank account,
- electronic payments processed by a payment operator,
- cash on delivery upon receipt of the shipment (for selected Goods),
- payment card.
A receipt is issued for every Order or — at the Customer’s request — a VAT invoice.
VI. Delivery costs and times
The Goods are delivered within the territory of the Republic of Poland and — by prior arrangement — abroad. The delivery cost depends on the chosen shipping method and the weight of the parcel, and is communicated to the Customer before the Order is placed.
The delivery time is the sum of the Order processing time and the carrier’s estimated delivery time. The Seller makes every effort to dispatch the Goods as quickly as possible.
VII. Complaints regarding the Goods
The Seller is liable to the Consumer for any non-conformity of the Goods with the contract under the rules set out in the Consumer Rights Act and the provisions of the Civil Code.
Complaints should be submitted in writing or by e-mail to [email protected], stating the Customer’s details, a description of the defect, the date it occurred and the expected way of resolving the complaint.
The complaint will be considered within 14 days of its receipt. No response within this period means the complaint is deemed justified.
VIII. Complaints regarding the operation of the website
Complaints related to the technical operation of the Store may be submitted to the Seller’s e-mail address. The Seller will consider the report within 14 days and inform the Customer of the outcome.
IX. Right of withdrawal and returns
A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason, by submitting an appropriate statement to the Seller. Sending the statement before the deadline expires is sufficient to meet it.
The returned Goods must be sent back to the Seller’s address no later than 14 days from the day of withdrawal from the contract. The direct cost of returning the Goods is borne by the Consumer.
The right of withdrawal does not apply to Goods made to the Consumer’s individual order or strictly tailored to their needs (e.g. personalized lamps).
X. Personal data protection
The controller of Customers’ personal data is LIGHTU Sp. z o.o. The data are processed for the purpose of fulfilling Orders, maintaining the Customer account, handling complaints and — with separate consent — for marketing purposes.
The Customer has the right to access their data and to have it rectified, erased, restricted in processing or transferred, as well as the right to object. The detailed rules of personal data processing are set out in the Privacy Policy.
XI. Final provisions
In matters not regulated by these Terms & Conditions, the provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
The Seller reserves the right to amend these Terms & Conditions for important reasons. Amendments come into force on the date indicated by the Seller, no sooner than 7 days after their publication. Orders placed before the amendments come into force are processed under the previous rules.
These Terms & Conditions are effective from the date of their publication on originsoflight.com.
